King Obama has once again demonstrated that he has no regard for our laws. He IS the law. Yesterday, the Anointed One signed an executive order gutting out the Clinton-era welfare reform act that required able-bodied adults to seek employment or take classes in exchange for welfare. With a single stroke of a pen, that hard fought legislation has been tossed into the dustbin of history. But of course, there is a caveat. States must beg the Department of Health and Human Services for a waiver. The Department of Health and Human Services believes the waivers would help parents “successfully prepare for, find, and retain employment.” The department encouraged states to begin testing a range of new strategies, policies and procedures designed to improve employment outcomes for the needy.
The move gives states the ability to apply for waivers, but those applications would still have to be approved by the secretary. Two states with GOP governors, Utah and Nevada, have submitted requests for a waiver so far, while three additional states, Connecticut, Minnesota, and California, have asked about the potential for waivers.
Waivers have to be approved by the Secretary of Health and Human Services? That agency is becoming all powerful. Soon, we won’t be able to wipe our ass without a waiver from a bureaucrat at the DHS.
But what is even more insidious is that Obama’s executive order violates the 1996 law. Rush Limbaugh gave the best explanation:
So how did Obama do this? What was the trick? "The Obama Administration issued a new directive stating that the traditional TANF work requirements can be waived or overridden by a legal device called the section 1115 waiver authority under the Social Security law (42 U.S.C. 1315). Section 1115 states that 'the Secretary may waive compliance with any of the requirements' of specified parts of various laws. But this is not an open-ended authority: Any provision of law that can be waived under section 1115 must be listed in section 1115 itself. The work provisions of the TANF program are contained in section 407 (entitled, appropriately, 'mandatory work requirements'). Critically, this section, as well as most other TANF requirements, are deliberately not listed in section 1115; they are not waiveable."
Folks we no longer have a representative republic; instead, we’re being ruled by a president with a penchant for executive orders, and an army of bureaucrats who make and enforce laws via regulatory fiat. Is this what democracy looks like? Maybe in Hugo Chavez’s Venezuela.
