California Issues More Driver's Licenses to Illegal Aliens Than Americans

California is the Crimean Peninsula of the United States.  Latinos are the majority.  That should be expected with policies that legitimize illegal aliens, such as sanctuary cities and issuing driver’s licenses.  Here is an excerpt from Fox News:

More than half of all new California drivers’ licenses this year have gone to people who are in the country illegally, the state said Friday
The California Department of Motor Vehicles reported it has issued roughly 397,000 licenses to people who live in the country illegally. A total of 759,000 licenses have been issued in the first six months of the year. The DMV only issued 435,000 licenses in the first six months of 2014.
The new law initially generated huge interest causing long lines at motor vehicle offices in January and February. The DMV expects to see about one million more applicants over the next three years who are covered under new law.

Should we consider California a foreign country?  Why not?  They act like a sovereign nation.

We Have Driver's Licenses. Why not Voter's Licenses?

One of the rites of passage in becoming a responsible adult is obtaining a driver’s license.  We’ve all been through the rigors of passing both written and driving test before being allowed behind the wheel.  No one wants a pimply faced teenager let loose on the public without him first demonstrating knowledge of the rules of the road.

When I moved to North Carolina I had to take a written test, even though I had been driving for over ten years.  I, once again, had to take a test upon renewal a couple of years ago.  This is the state’s way of making sure I know what the hell I’m doing on the public thoroughfares.  This is reasonable.

So, why can’t we make voters take a test demonstrating they have knowledge of the rules of our republic?  Furthermore, shouldn’t there be a set of qualifications to ensure the safety of the public weal from ignorant, avaricious voters who don’t know, or care about the issues at large?  Hell, a majority doesn’t even know their state senator or representative, yet, they’re pulling the lever.

I admit this barrier will not stop the stupid.  Where there is a will, there is a way.  Besides, we are in a period when citizenship is not valued.   Illegal aliens flood our streets and they don’t have driver’s licenses.  I’m sure their voting as well.

Last year, I was driving on I-85, near Raleigh, when I happened to look in my rearview mirror.  A car was barreling down upon me.  Mind you, I was going at least 75 miles per hour.  I got the hell out of the way.  Sure enough, a young man flew by me as though I was standing still.  What was scary is he had a donut tire on the rear passenger side of his car.  That tire is for emergency purposes only.  Needless to say, I slowed down and stayed away from this imbecile.  I only wish we could do the same with liberal voters.

North Carolina Politicians Pander to Illegal Aliens

Politicians and pandering is a time honored tradition.  Special interest groups and their deafening squawks for a teat drown out the silent majority.  What is truly reprehensible is the amount of influence illegal aliens has over our elected representatives.  From the state to the federal level, everyone seems to be on board to legitimize these non-citizens.  North Carolina is no different.

In 2006, the Old North State passed a law no longer granting illegal aliens a driver’s license.  I remember what it was like to renew mine before that.  It was hell.  The “undocumented” within a 500 mile radius swarmed into North Carolina.  I thought I was transported into a foreign country.  Hardly any applicant spoke English.

Now, our legislators are making the same mistakes in the guise of “public safety.”
The legislation comes as the U.S. Senate looks ready to take up its own bipartisan legislation following a push from GOP leaders to moderate its tone toward the Latino community. Rep. Harry Warren, R-Rowan, and a primary sponsor, called the measure a "public safety" bill that strikes a balanced approach in an interview Thursday.

"To recognize that people here illegally are driving uninsured and untested and to do nothing about it is irresponsible," he said. "The federal government has tied our hands in so many ways with how we can address the illegal population, but this is one way we can."

The restricted licenses come with special identification numbers, a vertical format set apart from the usual horizontal design and a statement declaring the permit can't be used to verify legal residency. Applicants have to submit to criminal background checks, provide a passport or federal tax form, proof of insurance and proof of at least a year's residency in North Carolina that began prior to April 1, 2013.

Let’s translate that into what is happening on our southern border, since Obama declared de facto amnesty for a subset of illegal aliens:

Officials say the number of people entering the U.S. illegally is way up and, tragically, the number of undocumented immigrants who have been found dead in the unforgiving Texas Brush Country is way up, and is on path this year to beat last year's record for the number of people found dead in the ranch country.

Linda Vickers, who owns a ranch in Brooks County, which is Ground Zero for the immigration debate, pins the blame directly on talk of 'amnesty' and a 'path to citizenship' for people who entered the U.S. illegally.

She recalls one man being arrested on her ranch not long ago.

"The Border Patrol agent was loading one man up, and he told the officer in Spanish, 'Obama's gonna let me go'."

Border Patrol agents report that immigrants are crossing the border, and in some cases surrendering while asking, “Where do I go for my amnesty?”

"When you have amnesty waving in the wind, you're going to get an increase," Vickers says. "And when you get an increase, especially with this heat, you're going to get an increase in deaths."

She says the current increase in illegal immigrant entries began last summer, at almost exactly the same time as President Obama unilaterally announced plans to no longer deport young people who came to the U.S. as children with their illegal immigrant parents.

We should’ve learned from the failures of the Simpson-Mazzoli Act.  But politicians don’t care about past mistakes.  They only care about pandering to special interest groups.

N.C. Republican Legislators Propose Driving Privileges to Illegal Aliens

The unrelenting drumbeat for the legitimacy of illegal aliens is shocking.  North Carolina republican legislators are proposing a plan to authorize “driving privileges” to the invading hordes under the specious pretense of public safety.
Republican state Rep. Harry Warren, who last year co-chaired a special House panel on immigration, said this week that he planned to introduce his legislation Tuesday or Wednesday. He declined to share details, but he said the bill “focuses on an appropriate state-level response to the issue of illegally present persons in North Carolina.”

An estimated 325,000 people live illegally in North Carolina.
Details are still being finalized, but those familiar with the discussions say driving applicants likely would be required to prove they’ve lived in the state for a year and demonstrate proof of insurance. Those who pass all required tests will be eligible for temporary driving permits – not driver’s licenses. It’s unclear whether the one-year permit would be renewed.

North Carolina has a 9.4% unemployment rate.  Of course, it’s more like 14%.  And here we are extending privileges to foreigners who have no regard for our laws and sovereignty.

Citizenship means nothing to politicians.  Look out Roman Empire.  Here comes the United States.

N.C. Illegal Aliens Cry Havoc and Let Slip the Holocaust

Cry havoc and let slip the Holocaust.  Illegal aliens, Democrats, La Raza and the ACLU are screaming about the branding of North Carolina driver’s licenses designated to those who’ve been warranted deferment status by an unconstitutional decree by our lord and master: Barack Hussein Obama.
Listen to this new entitlement class howl.  Here are some examples of the righteous indignation of a non-citizen living in the United States:
Across the top of the new license is a pink strip. In the center, red capital letters say, “NO LAWFUL STATUS.”

On the side, another set of red capital letters say, “LIMITED TERM,” referring to the license holder’s two-year reprieve from deportation.

According to Moises Serrano, a Yadkin County immigrant activist who has applied for deferred action, the design is similar to the Star of David that Jews were forced to wear in Germany under the Nazi regime.
“This singles me out,” Serrano said. “Imagine trying to get on a flight at the airport, and you have to use this license. It’s an invasion of my privacy. I am undocumented and unashamed, but I say that on my terms.”

Do you get that?  Moises Serrano is undocumented and unashamed, and we will accept his terms!  We’re a bunch of Nazis for valuing our citizenship; and relegating this poor supplicant as the Jew in the punch bowl.  Wow, we are just a bunch of imperialist Americans infringing on his world-citizenship status.  He has a human right to squat wherever he pleases; except of course to go back to his native country.  How dare we Americans “invade his privacy”?

Of course, the ACLU and 100 law professors have stated that the Obama decree is legal.  But no one should trust this so-called civil rights organization and today’s academia when it comes to our Constitution, and it seems that North Carolina House Republicans have cast a suspect eye on such protestations, with good reason.  Article One; Section Eight gives Congress sole authority when it comes to rules of naturalization.   Proponents for an authoritarian government argue the following:

Nearly 100 law professors from top universities nationwide, including Wake Forest University, signed a letter last summer advising Obama that the executive branch has the authority to defer deportation of young immigrants -- just weeks before the president announced plans to do so.
“General authority for deferred action exists under the Immigration and Nationality Act ... which grants the Secretary of Homeland Security the authority to enforce the immigration laws,” the letter saids. “Though no statutes or regulations delineate deferred action in specific terms, the U.S. Supreme Court has made clear that decisions to initiate or terminate enforcement proceedings fall squarely within the authority of the Executive."

But they refused to acknowledge the limitations the Executive has when it comes to deferments.   The Volokh Conspiracy blog gave the best explanation:

There are at least a couple ways in which the Executive Branch has afforded groups of aliens blanket relief from deportation. One is Temporary Protected Status, which allows the Secretary of Homeland Security to “designate a foreign country for TPS due to conditions in the country that temporarily prevent the country’s nationals from returning safely, or in certain circumstances, where the country is unable to handle the return of its nationals adequately.” That said, I’m not sure TPS serves as that good of a precedent for the recently announced program, because TPS is conducted under express congressional authorization in the form of 8 U.S.C. § 1254a. There isn’t comparable express authorization for the recently announced program; indeed, the Administration sought such authorization and Congress demurred.

A better precedent for the Executive Branch to act unilaterally is Deferred Enforced Departure. As explained on the CIS website), DED is a “temporary, discretionary, administrative stay of removal granted to aliens from designated countries.”

Unlike TPS, DED emanates from the President’s constitutional powers to conduct foreign relations and has no statutory basis. (Because DED is not a statutory provision under the Immigration and Nationality Act it is not considered an immigration status.) The President designates DED for nationals of a particular country through either an Executive Order or a Presidential Memorandum.

As some proponents of the President’s action are quick to note, President Bush issued a Memorandum to Secretary Chertoff on September 12, 2007, granting deferred enforced departure to certain Liberians for a period of 18 months. See 43 Weekly Comp. Pres. Documents 1203 (Sept. 12, 2007). (While at OLC, I reviewed that Memorandum.)

But it’s not clear that Deferred Enforced Departure is a close fit as a precedent either, because it traditionally has been used only temporarily to prevent aliens from having to return to areas suffering from disturbances. It has been employed as an exercise of the President’s power to conduct the foreign relations of the United States, and it’s not self-evident that same power would permit the President to indefinitely suspend deportation for a much larger group of aliens who don’t confront the same circumstances in their countries of citizenship. That starts to sound more like Congress’s power “[t]o establish an uniform Rule of Naturalization,” U.S. Const. art I, § 8 cl.4. Indeed, this purportedly leaked DHS draft memo discussing the issue way back in February 2010 recognizes that this sort of program “would represent use of deferred action on a scale far beyond its limited class-based uses in the past.” (Careful readers will note the facial reason to doubt the memo’s authenticity—it purports to be a DHS document, and yet it’s time-stamped 5pm on a Friday.*)

This wouldn’t be the first time Obama has used unconstitutional means for political expediency.

North Carolina to Issue Driver's Licenses to Illegal Aliens

North Carolina is awarding illegal aliens a driver’s license.  Under the illegal directive of the Obama administration and the misguided advice by States Attorney General Roy Cooper, the pathway to legitimacy is being afforded to those who have broken our immigration laws.  What is really galling is the praise of the ACLU:

RALEIGH, N.C. — The N.C. Division of Motor Vehicles will begin issuing driver's licenses to illegal immigrants who qualify for federal work papers, starting March 25.

Thursday's announcement by DMV Commissioner Tony Tata comes less than a month after the North Carolina attorney general's office said the agency was legally required to issue licenses to those qualified under the Obama administration's Deferred Action for Childhood Arrivals program.
Federal authorities began accepting applications in August from immigrants brought to the United States without authorization as minors, granting those who qualify for work papers with an opportunity for renewal after two years.

Immigrant advocacy groups and the state chapter of the American Civil Liberties Union praised the decision by Republican Gov. Pat McCrory's administration as a victory for rule of law.

Victory for the rule of law?  How is this a victory for the rule of law?  The Obama administration for political purposes issued an executive order violating our Constitution.  Under Article One Section Eight only Congress has the authority to establish the rules for naturalization; not the executive branch.  This is anything but the rule of law.  This is a victory for those who do not value their citizenship.  This is a victory for those who believe laws only apply when it is to their benefit.

Los Angeles Mayor Designates Illegal Aliens a Privileged Class

No matter how much we try to curb the incentives that attract illegal aliens, unscrupulous politicians will find ways to circumvent the laws which are designed to deter them. The mayor of Los Angeles is a perfect example of a shameless panderer. He has directed the LAPD to ignore a law that would keep illegal aliens off the road.

A few weeks ago the mayor, Antonio Villaraigosa, directed the Los Angeles Police Department (LAPD) to stop impounding the vehicles of unlicensed drivers for 30 days as per state law. The measure is intended to keep potentially reckless drivers off the road and therefore protect the public. It applies to unlicensed drivers as well as those who have had their license revoked or suspended.

Under the law illegal immigrants make up the majority of the drivers who have their cars impounded because they can’t get licenses in California or most states. LAPD Chief Charlie Beck told the local newspaper that this presents an
“unfair burden” and “disproportionate blow” for illegal aliens, who he refers to as a “valuable asset to our community.”

So the chief has ordered his officers to give unlicensed drivers a chance to avoid having their vehicles impounded by calling someone with a license who would then be allowed to drive the car. The chief says it’s a “fairness issue” because there is a “vast difference between someone driving without a license because they cannot legally be issued one and someone driving after having their license revoked.”

And what about American citizens who didn’t bother to “legally” obtain a driver’s license? Will they be afforded the same considerations as an illegal alien? Are illegal aliens becoming a privileged class in the United States?

Durham, North Carolina Aiding and Abetting Illegal Aliens

The sanctuary city of Durham, North Carolina has been targeted by the Mexican Consulate as a testing ground for its specious Matricula Consular cards. A sizeable illegal alien population has infested the state and they need identification to give them a semblance of legitimacy; more importantly a substitute for a drivers license.

North Carolina law requires that applicants for driver’s licenses must provide a VALID social security card. This is a huge impediment to illegal aliens. The Durham City Council is trying to circumvent North Carolina law by not arresting minor traffic violators for not providing a drivers license; rather, all they have to do is show a legal form of identification.

The following resolution will be voted on by Durham’s city council on November 15:

RESOLUTION SUPPORTING RECOGNITION OF THE MATRICULA CONSULAR AS A VALID FORM OF IDENTIFICATION

Whereas, the City of Durham respects and promotes the right of all of its residents to equal treatment under the law; and

Whereas, many immigrants who could have obtained a driver’s license by using a tax ID number prior to 2005 are no longer able to do so now that current law requires a social security number; and

Whereas, if a Durham city law enforcement official discovers that a driver is not carrying a license when making a traffic stop for a minor violation such as speeding or not fully stopping for a stop sign, the officer would typically issue a citation rather than making an arrest, provided a) there are no indications of criminal activity or driving under the influence, and b) the driver has a valid ID card; and

Whereas, the Mexican Matricula Consular has been shown to be a highly secure form of identification, issued to Mexican citizens living in other countries and containing several levels of machine-readable verification; and

Whereas, acceptance of the Matricula Consular as a valid form of ID would not only assist in minimizing unnecessary and potentially life-changing arrests of hard-working residents guilty of no more than a minor traffic infraction, but would also be useful for banking, library, and other civil functions;

THEREFORE, BE IT RESOLVED, that the City Council of the City of Durham hereby formally supports recognition of a properly issued and obtained Mexican Matricula Consular as a valid form of identification, not substituting for a driver’s license, but authenticating a person’s identity, and, with regard to activities of the Durham Police Department, supports issuance of a citation to persons showing such identification in situations where a citation would be issued to any driver lacking a license but with another valid form of identification, while leaving discretion to the officer as to whether to arrest.

This Resolution is effective upon adoption

If this resolution passes, any illegal alien that hurts, maims, or kills an American citizen by a vehicle in Durham, North Carolina; that city and its council members should be sued.

City liability insurance companies almost certainly won't cover liability associated with accepting such a card, since it is a violation of Federal law to accept the card. So if a city accepts the card and a citizen is injured by an illegal alien, the citizen could likely sue individual city council members for their personal assets and life savings.

Specifically, a state or local government official or employee who provides any benefit or service to such a presenter possesses the criminal intent (mens rea) necessary for a felony indictment under Section 274 of the Immigration and Nationality Act, which provides criminal penalties for any act that "encourages or induces an alien to come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of law."
